Participant Liability Release & Assumption of Risk
Required for all paddle board–related bookings. Please read carefully before signing.
I, the undersigned Participant, wish to participate in stand-up paddle boarding and related on-water activities (the "Activity") offered by Koi & Canvas, its owners, instructors, employees, and agents (collectively, the "Released Parties").
Assumption of Risk. I understand that the Activity involves inherent and unavoidable risks including, without limitation: drowning; capsizing; collision; exposure to weather, sun, wind, and cold water; equipment failure; contact with marine life, debris, or other watercraft; and the negligence of other participants. I voluntarily accept and assume all such risks.
Release & Waiver. To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Released Parties for any and all liability, claims, demands, or causes of action arising out of or related to my participation in the Activity, including those caused by ordinary negligence.
Representations. I represent that I am in good physical condition, am able to swim, and have no medical condition that would prevent safe participation. I agree to wear the provided personal flotation device at all times on the water and to follow all instructions given by staff.
Governing Law. This agreement is governed by the laws of the state in which the Activity takes place. If any provision is held unenforceable, the remainder shall remain in full effect.
